“What am I being charged for?” Man Gets Revenge On The Parking System When They Fail To Explain What His Ticket Was For

A man recently took revenge on a petty parking clerk who wouldn’t answer his questions and got a massive win for the entire city. What a guy! Here’s what the mistreated motorist had to say.

Parking Was Beyond Difficult

The man began, “This happened in the mid to late 90s in a northern Midwest mid-sized city. Parking near my apartment (near a university) was only on-street parking.”

Finding a free parking spot was always a real pain, so the guy had to risk it. Sometimes he’d get a ticket, sometimes not.

Then one day, he received a parking ticket for violation 27. That’s all the ticket said. There was no information about why he’d got the ticket or what violation 27 meant.

“It wasn’t an alternate side violation. Not an expired meter issue. Not a loading zone thing. I just didn’t know what it was,” explained the man.

He Went To Find Out

The man took the ticket to the office, where he encountered a less-than-helpful clerk. In fact, this clerk was plain rude. She was the kind of clerk that gave all city administrators a bad name.

The guy politely asked what violation 27 meant. He didn’t know and didn’t want to get a ticket for it again. It was a perfectly reasonable request. But the clerk stonewalled the man, then rudely asserted, “We don’t have to tell you!”

The Man Got Angry

The man couldn’t believe it. He asked her who could tell him. The clerk shrugged and said, “Maybe the prosecutor’s office?”

That set the guy off, and now he was furious. So he put his checkbook back in his pocket (this was the 90s, remember!) and marched out of the office.

He Decided To Fight Back

There was no way he was going to pay for this ticket. Instead, he was going to fight it.

But first, he had to build his case. And that meant lots of long hours in the public library. But all the heavy reading soon paid off.

He Did His Research

“I settled in, flipped through pages, cross-referenced ordinances and statutes, and found something very interesting. I checked the court date on the ticket and made up my mind. I would fight City Hall!” explained the amateur paralegal.

He Went To Court

When the man showed up in court, the prosecutor gave him one last chance to pay the fine, plus court costs, to make the matter go away. The man shook his head. He wasn’t backing down now.

And then his big moment arrived.

The man recalled, “I stepped before the judge and said, ‘Your honor, I move to dismiss the ticket based upon a Due Process violation on the 14th Amendment.'”

In simple terms, he explained that he was being charged with something without being told what it was. The prosecutor’s neck snapped up, and her face went bright red. She was angry, embarrassed, and shocked. She hadn’t seen this one coming.

The Matter Was To Be Reviewed

The judge smiled, turned to the prosecutor, and said, “I’ve been waiting for someone to bring this up.” The prosecutor’s jaw dropped.

Then the judge took all the man’s paperwork and said she would take the matter under advisement.

The Ticket Wasn’t Valid

A few weeks later, the guy received a letter in the post. It explained that the city had failed to inform the guy of the parking violation. Therefore, the ticket was invalid. He wouldn’t have to pay.

The judge threw out the prosecutor’s case. The man had won!

And it was a win for everyone. His victory meant that every other ticket written under violation 27 would also be thrown out. So, every single ticket that had been written with no explanation as to why was no longer valid.

The man was so proud of his ‘underdog’ revenge on the whole city parking system that he shared it on the internet for others to enjoy.

People Responded

An online user said, “That judge was like a kid in a candy store that day.”

Another person wrote, “Every judge in the county heard about that. In this instance, they may just have stood up and applauded.”
